POSSESSION OF MARIJUANA

Marijuana possession laws vary by the amount of marijuana you are alleged to be in possession of.  Under the Possession of Marijuana Statute - 35 Pa. Stat. Ann. § 780-113, the following applies:

 

  • For 30 grams or less - misdemeanor charge which carries up to 30 days in jail, and a fine of $500.

 

  • For possession of more than 30 grams – misdemeanor charge which carries up to 1 year in jail and up to $5000 in fines. Automatic six month loss of license. If you are a first time marijuana offender, it is possible to get probation without a verdict. For second (2nd) offense possession charges, or multiple subsequent offenses, the penalties may double.

 

  • If you possess more than 30 grams of marijuana, you are at risk of being charged with possession with intent to deliver or distribute.
